Legislative Update from Fred Allen, CFRI:June 17, 2009
In our continuing effort to stop the language in HR 1728 Mortgage Reform and Anti-Predatory Lending Act that would devastate the real estate investing industry with regards to owner financing; Augie Byllott, Rob Arnold, Colleen Sharkey and I met with John Newstreet - Central Florida Regional Director - Senator Mel Martinez's main Florida office. We presented our case against Section 101 (3)(e) in HR 1728. Although John has the Senator's ear, the next step will be for the Orlando office to send our concerns up the chain of command to the Senator's Washington office.
Newstreet said that this issue just came up and our timing was perfect in bringing this issue to the Senator's attention. He further commented that we have a strong case for removing the private owner language from this bill. If the Senator agrees, John said they can work with Senator Bill Nelson's top staffers and others to recommend to the Senate Banking Committee that the subject language be deleted from HR 1728.
This is obviously a small step on a national issue, however we are having an effect. We need to motivate our membership to become proactive and send the letters and postcards to elected officials. Colleen will work on getting us press coverage so we can publicly state our concerns regarding the erosion of private property rights. John confirmed these actions may influence the outcome on this issue.
Complacency is the norm on legislative issues. I cannot over-emphasize the importance of this issue to our industry as well as our way of life as property owners. If we do not vigorously and passionately fight this attack on our freedom and our industry, we have no one to blame if this bill passes with the current language which drastically impairs our ability to conduct our businesses and erodes our inalienable rights as property owners.

National REIA responds to HR 1728
HR 1728 is a devestating bill to the real estate investing industry, especially to those that participate in seller assisted financing. HR 1728 has passed the house and is expected to be heard in the Senate in the upcoming month. We are working on both notifying investors on the seriousness of this bill as well as developing systematic and reasonable responses.
